HOLIDAY RENTAL AGREEMENT 

Welcome to Flamingo Realty & Burrum Heads Holiday Homes.

We are excited to have you staying with us and we hope you enjoy your holiday.

It is a condition of your booking that you read this Agreement as it sets out the terms for your stay and forms the basis of your booking Agreement with us.

​This Agreement is between the Responsible Adult "You" who made the booking and Flamingo Realty & Burrum Heads Holiday Homes.

Flamingo Realty & Burrum Heads Holiday Homes act as the Agent for the Owner of the Property and accept bookings in that capacity.

All bookings must be registered to an adult with a minimum age of 21 years, the Responsible Person. We may request a copy of Your driver’s licence for ID.

Licence to use of the property is subject to the terms of this Agreement and nothing in this Agreement prevents the representatives of Flamingo Realty & Burrum Heads Holiday Homes to entering the property if required.

Payment of your booking deposit confirms You have read and agree to the terms of this this Agreement.

You are solely responsible for determining whether the property is fit for the Your purpose. 

Terms of the Rental Agreement

  • The person who enters this Agreement as the guest will be nominated as the primary point of contact and the person responsible for managing the booking on behalf of all guests. You, The Responsible Adult.

  • You, The Responsible Adult warrants that You are at least 21 years of age.

  • Your accommodation is for short-term residential purposes only.

  • The booking does not fall under the Residential Tenancies Act.

  • The property must not be used for unlawful purposes.

  • You and Your guests are responsible for keeping the property secure during the stay and may be held responsible for any theft or damage due to the property due to it being unsecured.

  • Damage to the property or its inclusions by You, Your guests, or their visitors, other than fair wear and tear, must be reported to our holiday rental staff as soon as possible and arrangements made for You to pay for the cost of repair

  • You, The Responsible Adult warrants that the information You have provided is accurate and complete, including but not limited to the number of guests that will be staying at the property.

  • You, The Responsible Adult must ensure that all of Your Guests as well as any invitees and any other persons who attend the property during the booking understand and agree to this Agreement and comply with all of your guest's obligations under this Agreement.

  • The date of this Agreement is the date You made this booking for the use of the property.

  • You are required to pay for the use of the property and payment is to be made as per the schedule on the booking confirmation.

  • No property keys or access codes can be issued until receipt of all interim and final payments including the Security Bond payment have been received and cleared by our bank.

  • The first date that You and Your guests are entitled to stay at the property is the "From" date booked

  • The last date that You and Your guests are entitled to stay at the property is the "To" date booked.

  • Check in time is from 2:00pm on the first date booked

  • Check out time is anytime up to 10:00am on the last date booked. Extra charges may apply if You or Your guests do not vacate by 10:00am, unless previously arranged.

  • The maximum number of guests that are allowed to stay at the property overnight is the number as described on the booking confirmation.

  • The number of pets that are allowed at the property is the number as described on the booking confirmation.

  • The property may only be used for short term residential accommodation. No weddings or other events are to be held at the property.

  • You and Your guests are responsible for keeping the property secure during the stay and will be responsible for any theft or damage due to neglect in this area.

  • Damage to the property or its inclusions by You, Your guests, or their visitors, other than fair wear and tear, must be reported to our holiday rental staff as soon as possible and arrangements made for You to pay for the cost of repair or replacement.

  • Furniture is not to be moved around. Items are not to be moved from room to room. If there is any damage caused to the property by the moving of furniture then repair costs may be charged to You.

  • If keys and/or remotes are lost, replacements may need to be changed at Your expense.

  • Should You or Your guests lock themselves out of the property a call out fee of $30.00 may be applicable.

  • Any areas designated as private by the owners are strictly out of bounds.

  • Children must not jump on beds. Damage resulting from children jumping on beds will be at the cost of the guest.

  • It is recommended that You take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during Your travel period. No liability is accepted for any injury, debt, damage, loss, delay, expense, or inconvenience caused directly or indirectly by events beyond the Agent or Owner’s control. No responsibility is taken for Your or Your guest’s property left on or near the premises.

  • Parties and Functions are strictly prohibited.

  • You and Your guests must comply with the by-laws, rules, and regulations of the Body Corporate (if applicable) and any reasonable direction of the operator.

 

Christmas, Easter, School Holiday bookings

All peak seasonal bookings are to be paid in full at least 30 days prior to entry date. If full payment is not received by the due date this may result in cancellation of the booking.

 

Tariffs

Tariffs are current as per the Tariffs listed on the booking platform.

A $55.00 Booking Fee is included in the total booking Tariff.

Housekeeping is included in the total booking Tariff.

Please note that any verbal quote given is an estimate of price only which will be subject to a written confirmation of the reservation.

The price of the accommodation cannot be guaranteed unless payment of the full deposit is received within 48 hours of the booking.

In the case of date altered bookings, the prevailing tariff for the changed booking dates at time of change will be applied to new amended booking.

 

Security Bond 

A refundable security bond will be payable in addition to the total booking Tariff charged when booking unless otherwise detailed.

Bond amounts are specific to each property and range from $500.00 - $1,000.00.

The Bond is to be paid 7 days prior to the arrival date. We are unable to issue keys to the property or allow access to the property until the security bond payment has been received.

The security bond will be held in Trust until the completion of the booking and a final check of the property on vacating.

The final check of the property will be completed within 3 - 5 days of vacate.

Security Bond payments can be made by bank transfer or by credit card. The Bond is securely held in our Trust account. Refunds are made by direct deposit to your nominated bank account. We are unable to refund a bond back onto a credit card.

 

Booking Payment Methods Accepted

We accept Visa, MasterCard, and Bank Transfer.  We are unable to accept Cash.

Credit cards used for payment of accommodation must be in the name of the person who is the responsible person for the booking. A copy of the card may be requested.

 

Pets

  • Pets are not permitted on the property unless the property is advertised as Pets Welcome or Pets Allowed.

  • Service animals specifically trained to aid a person with a disability are always welcome by prior arrangement.

  • Permitted pets are to remain outside at all times unless inside approval is given prior to your arrival. We may ask for pictures of your pets prior to an inside approval being given.

  • Inside approval does not grant approval for pets to be on furniture or in carpeted rooms or bedrooms or on beds. If there is evidence of pets having been inside the home without prior approval or, if there is evidence of pets having been in carpeted rooms or bedrooms or on beds or on other furniture then there may be additional cleaning fees, at cost, of carpets, furniture and or bedding. Damaged or pet stained linen that needs to be replaced will be charged to you at cost.

  • Upon departure of the property You are responsible for removing all animal droppings and dog bones from the property and dispose of them into the correct wheelie bin. There are pooper scoopers and doodoo bags available in the property for that purpose. If this does not occur a cleaning fee may be charged.

 

​Fire Pits or Braziers 

  • Fire pits or Braziers are not permitted to be brought onto the property by You or Your guests.

  • Fire pits are not permitted to be constructed on the property by You or Your guests unless a fire pit area has been designated by the owner.

  • when a fire pit or brazier is supplied by the property owner consideration by You and Your guests must be given to the smoke drift into neighbouring properties. The fire pit or brazier must be put out immediately when nuisance smoke develops or has been brought to your attention by others.

  • when a fire pit or brazier is supplied by the property owner it is a requirement that all Fraser Coast Fire ban regulations are followed by You or Your guests. Peaceful Neighbourhood – Quiet time is from 10:00pm to 8:00am every night

You or Your guests must not do anything which may reasonably be considered to cause a nuisance or annoyance to anyone in the community or to representatives of Flamingo Realty & Burrum Heads Holiday Homes.

A nuisance or annoyance can include, but is not limited to the following -

  • noise caused by loud music

  • noise from loud singing

  • noise from loud TVs

  • noise from motor vehicles or boats

  • use of indecent language that is audible to neighbouring properties or is addressed directly to neighbours or to anyone in the community

​​In the event that representatives of Flamingo Realty and Burrum Heads Holiday Homes are required to speak to You or Your guests concerning our Peaceful Neighbourhood or the Fire Pits or Braziers policies and, if You or Your guests do not prevent the nuisance or annoyance from reoccurring, we reserve the right to call the Police in relation to the behaviour.

 

The property condition

At Flamingo Realty & Burrum Heads Holiday Homes we pride ourselves on the clean & tidy presentation of the property You have booked.

From time to time there can be unforeseen events that are out of the control of the Agency or the Owners.

These events may include, but not limited to break downs of a television, stereo, fridges, Wi-Fi, other appliances, plumbing, electrical systems, or lights. If a break down event happens we will strive to fix the break down quickly and with the least disruption to your holiday where possible. The timing of the repair or replacement is controlled by the supply of materials or products and the availability of Contractors.​

 

​Liability

  • You and Your guests must take all reasonable and necessary steps to safeguard personal property.

  • You and Your guests must observe any safety directions, instructions or signage and look out for their own wellbeing while staying at the property.

 

Breach of this Agreement

Any breach or anticipated breach by You or Your guests of any of the terms of this Agreement will permit a representative of Flamingo Realty & Burrum Heads Holiday Homes to enter the Property, to discuss and resolve the breach.

​​You and Your guest's statutory rights are governed solely by any applicable laws, such as Australian Consumer Law and other similar or related consumer protection laws.

Cancellations Are in accordance with the Cancellation Policy of the booking platform.
